Drake records agreement reached by prosecutor, defense

CORUNNA - A scheduled court hearing regarding the use of medical records in Harlan James Drake's double murder case was canceled Tuesday when attorneys came to an agreement on the files before the meeting.

Attorney Robert Ashley and Shiawassee County Prosecutor Randy Colbry were scheduled to meet regarding which medical records from the Center for Forensic Psychiatry could be accessed by both parties as well as what an “acceptable setting” for an evaluation was.

Ashley said the defense's independent psychiatrist may record video and audio of Drake and potentially use those in court at a later time. Colbry also may access information and records conducted by the Center for Forensic Psychiatry.

“We had a meeting of the minds and came to a compromise on some issues,” said Ashley, who filed a notice of insanity defense for Drake in order to explore his mental state further.

A preliminary hearing is scheduled for 8:30 p.m. Dec. 3 in the 66th District Court.

" Let's hope that the prosecutor will also get to use the records from the State regarding Mr.Drake's mental state when he purchased and registered his guns (there is a current law regarding this). Shiawassee County.....let's set the good example and have a FAIR and JUST trial........people murder everyday just because or is everyone just simply incompetent. "

Good. Colbry decided to show a little common sense after all. Hopefully he can keep it up. "
